Seasonal Rental – Furnished Tourist Accommodation
1. Purpose
These General Terms and Conditions of Sale (hereinafter ""GTCS"") define the rights and obligations of the parties in the context of the remote booking and seasonal rental of the furnished tourist accommodation offered by the establishment located in Lauzerte (Tarn-et-Garonne, France).
They apply to all bookings made online via the establishment's booking platform.
The client acknowledges having read these General Terms and Conditions of Sale, as well as the specific conditions of the selected rate available on the booking platform, and having accepted them prior to confirming the reservation.
Any reservation implies full and unconditional acceptance of these terms and conditions.

2. Reservation
The client selects the services presented on the booking platform.
The client acknowledges having read the nature, destination and booking conditions of the services offered and having obtained all necessary information before making the reservation.
The client is solely responsible for the choice of services and their suitability for their needs. The establishment cannot be held responsible in this respect.
The reservation is deemed accepted by the client once the booking process has been completed.

3. Booking Process
Reservations are made via the online booking form available on the platform.
Prior to any reservation, the client undertakes to complete the required information and certifies that the information provided is accurate and truthful.
After selecting the services to be booked, the procedure includes:
• entering payment or credit card guarantee information
• reviewing and accepting these General Terms and Conditions of Sale
• final confirmation of the reservation by the client.
The reservation becomes binding once confirmed by the establishment.

4. Booking Confirmation
The booking platform acknowledges receipt of the reservation by sending a confirmation email.
This confirmation email summarizes in particular:
• the services booked
• the total price of the stay
• the sales conditions related to the selected rate
• the booking date
• the establishment's contact details for any complaint or request.

5. Payment Terms
For advance reservations:
• a deposit of 30% of the total stay amount is paid online by credit card via the secure payment platform Stripe at the time of booking;
• the remaining balance must be paid no later than 30 days before the arrival date, by bank transfer, according to the bank details provided by the establishment in the booking confirmation.
If the balance is not received within this period, the establishment reserves the right to cancel the reservation. The deposit will remain retained by the owner as compensation.

6. Cancellation Policy
In accordance with Article L.221-28 of the French Consumer Code, accommodation services provided on a specific date are not subject to the right of withdrawal.
In the event of cancellation by the client, the following conditions apply:
• more than 30 days before arrival: the deposit (30% of the stay) remains due
• between 30 and 7 days before arrival: 50% of the total stay amount is due
• less than 7 days before arrival or no-show: 100% of the total stay amount is due
Any stay that has begun or is shortened remains fully payable.

7. Cancellation by the Owner
In the event of exceptional cancellation by the owner (force majeure or inability to accommodate guests), all sums paid will be fully refunded to the client without additional compensation.

8. Arrival and Departure
Standard times are as follows:
• Check-in: from 4:00 PM
• Check-out: before 10:00 AM
Alternative times may be granted upon request and subject to availability.

9. Accommodation Capacity
The accommodation is intended for the maximum number of guests specified at the time of booking.
Any undeclared additional guest may result in:
• refusal of access to the accommodation, or
• additional charges.

10. Prices
Prices are indicated in euros, all taxes included (TTC).
The rates applied are those in effect at the time of booking.
Unless otherwise stated, the following are not included in the price:
• tourist tax (taxe de séjour)
• optional additional services.
The tourist tax must be paid in accordance with local regulations.

11. Security Deposit
A security deposit of €300 may be required upon arrival to cover potential damage or missing items.
It will be refunded within a maximum period of 7 days after departure, after deduction of:
• repair costs
• replacement costs
• additional cleaning costs if required.

12. Use of the Property
The tenant agrees to:
• respect the peaceful nature of the premises
• use the equipment in accordance with its intended purpose
• return the accommodation in proper condition.
Parties and events are not permitted without prior approval from the owner.
Any behavior contrary to public order or good conduct may result in immediate eviction without refund.

13. Swimming Pool
The swimming pool is a private, unsupervised swimming pool.
Its use is entirely under the responsibility of the users.
Children must be supervised at all times by an adult.
The owner cannot be held responsible for accidents resulting from improper use.

14. Insurance
The tenant is responsible for any damage caused during the stay.
The tenant is required to hold insurance covering holiday rental liability (""villégiature"" liability) for any damage that may be caused to the accommodation or its equipment.

15. Personal Data Protection
The information collected during the booking process is necessary for the management of the stay.
It may be transmitted to service providers involved in managing the reservation, including the booking platform elloha and the payment provider Stripe.
These data are processed in accordance with applicable personal data protection regulations.

16. Evidence Agreement
The entry of payment details and acceptance of these terms and conditions constitute an electronic signature having the same legal value as a handwritten signature.
Computerized records stored by the booking platform constitute proof of transactions between the parties.

17. Consumer Mediation
In accordance with the French Consumer Code, the client may have access to a consumer mediation service for the amicable resolution of disputes.
After a prior written request to the establishment, the client may refer the matter to the relevant mediator.

18. Disputes
These General Terms and Conditions are governed by French law.
In the event of a dispute, the parties will seek an amicable solution.
Failing this, the dispute will be brought before the competent courts of the location of the rented property.
